Terms of Service

MyPanion provides companion care services for NON-EMERGENCY appointments ONLY.
For medical emergencies, life-threatening conditions, or urgent medical situations, CALL 911 IMMEDIATELY.
Do not use MyPanion services for emergency situations.

1. Acceptance of Terms

By accessing our website (mypanion.com), booking our services, or using MyPanion services, you agree to be legally bound by these Terms of Service ("Terms"). If you do not agree, please do not use our services.

MyPanion is operated by Wolleritian Ventures LLC, a Florida limited liability company. These Terms constitute a binding agreement between you and Wolleritian Ventures LLC.

2. Service Description

What We Provide:

Complete accompaniment service to and from appointments
Professional companion accompaniment throughout your visit
Three service tiers: Basic, Standard, and Premium
Optional add-ons: Wheelchair assistance, transfer support, pharmacy/grocery stops, extra errands
Real-time SMS updates about companion assignment and arrival

3. Eligibility

You must be at least 18 years old to book our services. If booking on behalf of a minor or another person, you represent that you have legal authority to do so and to provide consent for SMS communications.

Additional Fees

Add-on services: Wheelchair assist ($10), Transfer assist ($15), Pharmacy stop ($15), Grocery stop ($30), Extra stop ($15)
Long-distance travel: 20-40 miles (+$40), 40-75 miles (+$75)
Long-Wait Adjustment: Applied if appointment exceeds plan time (one flat fee, not hourly)
Same-day booking bonus: 100% to companion (no extra charge to you)

Payment Process

Submit your booking request through our website
We verify companion availability (typically 15-30 minutes)
You receive a secure Stripe payment link via SMS
Complete payment to confirm your booking
No payment is collected on the booking form itself

6. Your Responsibilities

By using MyPanion services, you agree to:

Provide accurate information when booking (client details, assistance needs, addresses)
Disclose mobility and assistance considerations necessary for safe service
Be ready for pickup at the scheduled time
Treat companions with respect and courtesy
NOT use our services for emergency medical situations
Comply with all applicable laws
Notify us immediately of any changes to your appointment or contact information

7. SMS Communications

By providing your phone number and consenting to SMS notifications, you agree to receive text messages from MyPanion regarding your companion care services.

8. Companion Services

MyPanion coordinates services with independent contractor companions. While we carefully screen and select companions, they are independent contractors and not employees of Wolleritian Ventures LLC. Companions receive 1099 tax forms.

9. Limitation of Liability

IMPORTANT LEGAL NOTICE:

MyPanion provides companion care for NON-EMERGENCY appointments only. We are not a medical provider and do not provide medical care, advice, or emergency services.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WOLLERITIAN VENTURES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR SERVICES.
Our total liability for any claims shall not exceed the amount you paid for the specific service giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless Wolleritian Ventures LLC from any claims, damages, losses, or expenses (including attorneys' fees) arising from: (a) your use of our services, (b) your violation of these Terms, or (c) your violation of any rights of another person or entity.

11. Modifications & Termination

Modifications: We reserve the right to modify these Terms at any time. Changes will be posted with a new "Effective Date." Continued use of our services after changes constitutes acceptance.

Termination: We reserve the right to refuse service or terminate your access at any time, with or without cause, including for violation of these Terms.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict of law provisions.

Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, conducted in Broward County, Florida.

13. Privacy

Your use of our services is governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.
